The Gasabo Intermediate Court yesterday remanded retired Captain David Kabuye to jail for a month on grounds that there was no proof that he would be available whenever the judiciary wanted him.

Kabuye, a Kigali-based businessman, had on Monday requested that the case in which he is accused of illegal possession of a firearm, be heard when he is out of custody.

“Considering that Kabuye is a proven civilian who kept the gun illegally for 15 years and considering that he told court that he is a businessman who frequently travels abroad; court cannot grant him bail on grounds that he may not be available any time he is wanted. It is on this note that he is remanded to jail for 30 days,” ruled Judge Jean Baptiste Bandora.

The judge also disregarded Kabuye’s sureties on the basis that they have no ability to stop him from traveling if he decided to.

Kabuye was offering in his wife, Lt. Col. (rtd) Rose Kabuye, and his two siblings, as sureties.

Immediately after the court’s decision, Kabuye announced that he would appeal against the decision.

“We are surprised with the court’s decision, my client told court that he is a member of the reserve force and every time he is to travel he seeks permission from the reserve force commander,” his lawyer, Godfrey Butare said after the ruling.

He said his client did not have intentions to travel anywhere.
